Terms of service

1. Identification and scope

This website and its booking engine are operated by Premium Host Punta or PHPunta (hereinafter, “PHPunta”), in its capacity as manager, marketer and operator of short-term rentals offered on its own behalf or on behalf of owners, administrators or titleholders of the properties listed.

Depending on the property and the applicable operating model, PHPunta may act as commercial intermediary, operating administrator, agent, booking manager or full-service provider related to the stay.

Using the website, sending inquiries, requesting availability and/or making a booking imply acceptance of these Terms of Service, together with the Privacy Policy, the Cookie Policy and the specific conditions reported for each property.

2. Nature of published information

The descriptions, photographs, surfaces, amenities, distances, views, services and other published data for each property are informational in nature and seek to reasonably reflect their characteristics at the time of upload.

However, non-substantial variations may occur due to updates, maintenance, furniture changes, owner decisions, renovations, weather conditions, third-party service availability or other circumstances beyond PHPunta's direct control.

3. Booking process

A booking shall only be considered finalized once the following have occurred, as applicable:

a. express confirmation of availability;

b. proper identification of the lead guest;

c. acceptance of applicable terms;

d. full or partial payment as required; and

e. issuance of confirmation by PHPunta or the enabled booking system.

PHPunta may reject booking requests when there are inconsistencies in the data provided, operational impossibility, prior breaches by the guest, specific property restrictions, or reasonable reasons of security, coexistence or regulatory compliance.

4. Prices, currency and taxes

Published prices may be expressed in US dollars, Uruguayan pesos or another currency indicated on the site. Unless otherwise stated, amounts correspond to the value of the stay and may not include additional charges such as processing fees, cleaning, security deposits, fees, taxes, extraordinary consumption or other items duly reported before final confirmation.

PHPunta strives to keep rate information up to date; however, until the booking is confirmed, prices and conditions may be modified without prior notice.

5. Payment methods

Payments may be made through electronic gateways, cards, bank transfers or other means enabled by PHPunta.

The guest warrants that they are using their own or duly authorized payment methods. Every transaction will be subject to security validations, fund confirmation, anti-fraud controls and/or additional verifications that PHPunta, the payment gateway or the card issuer deem necessary.

6. Security deposit and additional authorizations

For certain properties or bookings, PHPunta may require a security deposit, pre-authorization, temporary hold, documentary guarantee or equivalent mechanism to cover damages, missing items, extraordinary consumption, breaches, fines or costs attributable to the guest or their companions.

The conditions of such guarantee —amount, method, release deadline and total or partial retention scenarios— will be reported before or during the booking process.

7. Check-in, check-out and identification

Entry and exit times will be those reported for each booking or property. Compliance is essential for operational coordination.

The lead guest must provide truthful information and, when requested, verify their identity, list of occupants, contact data and other elements reasonably necessary for managing the stay.

PHPunta may deny access or cancel the booking if:

a. the guest's identity does not match the booking;

b. undeclared occupants are detected;

c. the maximum authorized capacity is exceeded;

d. there are reasonable indications of improper use of the property; or

e. documentary or payment requirements are not met.

8. Permitted use of the property

The guest undertakes to use the property and its facilities in a diligent and responsible manner, consistent with its intended use, respecting at all times:

a. the maximum authorized capacity;

b. coexistence and good behavior rules;

c. the internal regulations of the building, neighborhood or complex;

d. safety rules; and

e. the operational instructions communicated by PHPunta.

Unless expressly authorized in writing, the following are prohibited:

  • holding parties, events or mass gatherings;
  • subletting or transferring occupancy to third parties;
  • accommodating undeclared persons;
  • carrying out illicit, bothersome, dangerous activities or activities contrary to morality and good customs;
  • improperly handling installations;
  • bringing pets where they are not allowed;
  • smoking in spaces where it is prohibited.

Non-compliance may result in immediate cancellation of the stay, retention of amounts, loss of the security deposit and damage claims.

9. Property condition, damages and observations

The guest must report within a reasonable period from their entry any relevant observation about the condition of the property. Absent timely notice, the unit will be presumed to have been received in adequate conditions of use, cleanliness and general functioning, barring evidence to the contrary.

The guest shall be liable for damages, missing items, breakages, extraordinary uncleanliness, abusive use, loss of keys, controls, access devices, fines or additional costs caused by them, their companions, guests or persons linked to their group.

10. Services, equipment and contingencies

PHPunta will make reasonable efforts to deliver the property in adequate condition. However, it does not guarantee the uninterrupted continuity of services beyond its direct control, including but not limited to:

  • electricity;
  • water;
  • internet;
  • cable or streaming;
  • gas;
  • elevators;
  • building services or common amenities;
  • public or private third-party services.

Nor will it be liable for events arising from weather, nearby construction, external noise, general outages, force majeure, authority provisions or events beyond its reasonable sphere of control.

11. Cancellations by the guest

Unless specific conditions are indicated for a property or season, the following general policy will apply:

  • more than 7 calendar days before check-in: 50% refund of the amount paid for low-season bookings (April to November);
  • less than 7 calendar days before check-in: non-refundable amounts.

During high season, special dates, promotional bookings, long stays or properties with specific policies, stricter or non-refundable conditions may apply, which will prevail over this clause when reported before confirmation.

Early departures, no-shows, voluntary stay reductions or withdrawals once the accommodation has started shall not give rise to refunds, except by express decision of PHPunta.

12. Modifications or cancellations for exceptional reasons

If due to extraordinary cause, force majeure, operational impossibility, accident, unforeseen unavailability of the property or any situation not attributable to PHPunta the property cannot be delivered under the agreed conditions, PHPunta may, as applicable:

a. offer an alternative property of reasonably equivalent or superior characteristics;

b. reschedule the booking; or

c. refund the amounts effectively charged that are legally or contractually applicable.

Except in cases of willful misconduct or gross negligence, such a situation will not generate additional liability for loss of profit, indirect damages, incidental expenses, external relocations or supplementary compensation.

13. Limitation of liability

To the maximum extent permitted by applicable law, PHPunta shall not be liable for:

  • forgotten, lost or stolen items;
  • accidents arising from imprudent use of the property or its facilities;
  • damages caused by unrelated third parties;
  • interruptions of services not directly controlled by PHPunta;
  • subjective expectations not expressly guaranteed in the booking.

Nothing in the foregoing shall exclude liability that cannot be legally limited.

14. Communications

The guest accepts that communications related to their inquiry, booking, stay, incidents, charges, modifications and post-stay may be made by email, WhatsApp, phone call, SMS or other reasonable means of contact.

15. Data protection

The processing of personal data is governed by the Privacy Policy available on this site and by applicable regulations.

16. Applicable law and jurisdiction

These Terms of Service are governed by the laws of the Oriental Republic of Uruguay.

Any controversy shall be submitted to the jurisdiction of the competent courts under applicable regulations, unless a mandatory provision establishes another solution.
